The whole premise of the argument seems to be that there is no way to tell which round was fired. I would submit that if you reload at all you are likely to be in the same boat, even if you do only use factory ammo for defense.
For example; I still have a box of Blazer Brass .45 loaded with Speer Gold Dots. I also have some hand loads that I assembled using the brass from another couple of boxes of that ammo. 50 rounds of that was loaded with Speer Gold Dot bullets. There is no way anyone could tell from the outside which is which, and as was mentioned in the article, once it is fired the evidence is gone.
There would be no way for anyone to determine weather I used the factory ammo or my own. Except for possibly a chemical analysis of the powder residue. According to the article, that could get me into trouble in and of itself.
